General Terms and Conditions of Sale, Booking and Rental

Last updated: 3 September 2026

These General Terms and Conditions of Sale, Booking and Rental, hereinafter referred to as the “Terms and Conditions”, apply to direct bookings for the “Jacques Charles” and “Chez Suzon” holiday cottages made through the website https://gite-aerostier.fr/.

Article 1 – Identity of the Operator

The accommodation services are provided by Christophe Blanchard, sole trader (French legal status: entrepreneur individuel – EI), operating under the trading name “Gîtes de l’Aérostier Blanchard”.

Address: 2 impasse de la Giraudière, 45370 Jouy-le-Potier, France

SIREN number: 306 205 717

SIRET number: 306 205 717 00078

Telephone: +33 (0)6 80 68 29 98

Email address: christopheblanchard45@yahoo.fr

In these Terms and Conditions, Christophe Blanchard is referred to as the “Operator” and the person making the booking is referred to as the “Customer”.

Article 2 – Purpose and acceptance of the Terms and Conditions

These Terms and Conditions define the respective rights and obligations of the parties in connection with the booking and temporary rental of accommodation for tourism purposes.

The Customer declares that they have the legal capacity to enter into a contract and that they are making the booking for their own personal requirements.

Before making payment, the Customer acknowledges that they have reviewed the essential features of the stay, the total price and these Terms and Conditions.

Ticking the acceptance box in the booking form and subsequently making payment constitutes full and unconditional acceptance of the version of the Terms and Conditions displayed on the booking date.

Article 3 – Accommodation features

The features of each holiday cottage, including its location, maximum occupancy, sleeping arrangements, facilities, included services and any restrictions, are stated on its presentation page and in the booking summary.

Photographs are provided for illustrative purposes. Certain decorative features or non-essential equipment may change without affecting the essential features of the accommodation.

Before booking, the Customer must ensure that the selected cottage meets their requirements, particularly regarding occupancy, accessibility and the accommodation of children.

Article 4 – Online booking

The Customer selects the cottage, available dates and any options offered. The Customer then enters the requested information, checks the stay summary and total price, accepts these Terms and Conditions and makes secure payment by bank card.

The booking only becomes firm and binding once Stripe has confirmed that the payment was successful and a confirmation email has been sent to the Customer.

An unpaid request, declined payment or interrupted transaction does not constitute a confirmed booking, even if the dates temporarily appear as pending in the booking calendar.

The Customer is responsible for ensuring that their contact details are correct. If no confirmation is received, the Customer must check their spam or junk email folder and then contact the Operator before making another booking.

Article 5 – Prices and tourist tax

Prices are displayed in euros and include all applicable taxes where relevant.

The contractual price is the price shown in the summary displayed before payment for the selected cottage, dates, number of occupants and any additional options.

Prices may vary depending on the season, length of stay, arrival day, availability and current offers. A subsequent change in prices will not affect an already confirmed booking.

Tourist tax and any additional taxes are charged in accordance with the rules and rates established by the competent local authority.

Where tourist tax is not included in the price of the stay, its amount or method of calculation will be communicated to the Customer before the booking is confirmed or, where required by local regulations, it will be collected separately.

Article 6 – Payment

Unless otherwise stated before booking, the total price of the stay is payable by bank card when the booking is made.

Payment is processed securely by Stripe. The Operator does not receive or retain the Customer’s full bank card number.

In the event of a declined, cancelled or fraudulent payment, or an unjustified payment dispute, the Operator may suspend or cancel the booking after notifying the Customer, without prejudice to any other remedies available to the Operator.

Article 7 – Length of stay, arrival and departure

The stay is booked for the dates stated in the booking confirmation.

Any minimum-stay requirements, permitted arrival days and seasonal restrictions displayed by the booking system form part of the contract.

Check-in is available from 5:00 p.m. and the accommodation must be vacated no later than 10:00 a.m. on the departure date, unless otherwise agreed in writing.

The Customer must notify the Operator in the event of a late arrival.

An unauthorised late departure may result in the Customer being charged for the actual costs and losses incurred, particularly if the accommodation cannot be prepared on time for the next guests.

Article 8 – Occupancy and guests

The total number of occupants, including children, must not exceed the maximum occupancy stated for the booked cottage.

The booking may not be transferred and the accommodation may not be sublet without the Operator’s prior written consent.

The Operator may refuse access to additional undeclared guests if their presence exceeds the permitted occupancy or breaches the booking conditions.

Article 9 – Cancellation or amendment by the Customer

Any cancellation request must be sent in writing to christopheblanchard45@yahoo.fr.

The date on which the message is received will determine which cancellation conditions apply.

  • More than 30 calendar days before the arrival date: refund of 100% of the amounts paid for the stay.
  • Between 15 and 30 calendar days inclusive before the arrival date: refund of 50% of the price of the stay.
  • Fewer than 15 calendar days before the arrival date: no refund of the price of the stay.

Tourist tax relating to unused nights will be refunded where it has been collected by the Operator and is not payable to the competent local authority.

Any request to change the dates or cottage is subject to availability and may result in a price difference.

A change will only be confirmed after written approval from the Operator. If no agreement is reached, the original booking and cancellation conditions will continue to apply.

Failure to arrive, a delayed arrival or an early departure does not entitle the Customer to a refund, unless otherwise agreed in writing by the Operator or required by mandatory law.

Customers are advised to take out suitable travel cancellation insurance.

Article 10 – Cancellation by the Operator and force majeure

If the Operator is required to cancel the stay before the arrival date, the Operator will, where possible, offer equivalent accommodation or alternative dates.

The Customer is free to refuse this proposal. In that case, the amounts collected for the cancelled stay will be refunded as soon as reasonably possible.

Neither party may be held liable for a failure to perform its obligations where that failure is directly caused by a force majeure event within the meaning of Article 1218 of the French Civil Code.

In such circumstances, the parties will contact each other to seek a proportionate solution, including postponing the stay where possible.

Article 11 – No right of withdrawal

In accordance with Article L. 221-28, point 12, of the French Consumer Code, the statutory 14-day right of withdrawal does not apply to non-residential accommodation services supplied on a specific date or during a specific period.

Once confirmed, the booking is therefore subject to the cancellation conditions set out in Article 9.

Article 12 – Use of the accommodation and house rules

The Customer agrees to use the accommodation peacefully and solely for its intended purpose.

The Customer must respect the neighbourhood, safety instructions, equipment, outdoor areas and any house rules provided before or upon arrival.

The cottages are non-smoking. Parties, events and commercial activities are prohibited without the Operator’s prior written permission.

Pets are only permitted with the Operator’s prior written agreement and subject to any conditions communicated to the Customer.

The Customer is responsible for the conduct of all persons they allow onto the property.

Any serious or dangerous breach, or any repeated nuisance, may justify the early termination of the stay, without prejudice to compensation for any actual loss or damage suffered.

Article 13 – Condition of the accommodation, cleaning, damage and security deposit

The Customer must report any issue identified upon arrival without delay.

The cottage, its equipment and keys must be returned in a condition consistent with normal use.

Any cleaning service included in the price does not release the Customer from the obligation to leave the property tidy, wash the dishes, dispose of waste in accordance with the instructions and avoid causing damage.

A security deposit may only be required if its amount, payment method and refund conditions were communicated to the Customer before the booking was concluded.

If this information was not provided before the booking was made, no additional security deposit will be requested upon arrival.

The Customer remains responsible for any damage, missing items and repair or replacement costs attributable to them.

Any amount claimed must correspond to documented loss or damage. If the cost of the damage exceeds the amount of any security deposit, the Operator retains the right to request payment of the additional amount upon presentation of the relevant supporting documents.

Article 14 – Liability and insurance

The Customer is responsible for damage caused by themselves, other occupants and any guests they invite onto the property.

The Customer must ensure that their personal liability insurance covers holiday rentals, including an appropriate holiday rental liability policy, and must provide evidence of such cover upon reasonable request.

The Operator is not responsible for the loss, theft of or damage to personal belongings, vehicles or valuables, except where such loss or damage results from fault attributable to the Operator.

Any incident or accident must be reported without delay so that the necessary measures can be taken.

Article 15 – Personal data

Personal data provided during the booking process is used to manage the booking request, payment, stay and customer relationship, comply with accounting and tax obligations and handle any complaints or disputes.

The data may be shared with service providers involved in website hosting, booking management, email delivery and payment processing, strictly to the extent necessary for the performance of their respective services.

Information about processing activities, retention periods and the Customer’s rights is provided in the website’s Privacy Policy.

Article 16 – Complaints and consumer mediation

Any complaint must first be sent to:

Christophe Blanchard
2 impasse de la Giraudière
45370 Jouy-le-Potier
France

Email: christopheblanchard45@yahoo.fr

The Customer should state their booking number and provide all relevant information required to review the complaint.

[TO BE COMPLETED BEFORE PUBLICATION: name, postal address and website of the consumer mediator appointed by Christophe Blanchard.]

If a prior written complaint cannot be resolved amicably, a consumer Customer may refer the matter to the appointed consumer mediator free of charge, subject to the mediator’s applicable conditions.

Article 17 – Applicable law and disputes

These Terms and Conditions and the rental agreement are governed by French law.

If no amicable settlement can be reached, including through mediation where applicable, the dispute will fall within the jurisdiction of the courts designated by the applicable rules governing territorial and subject-matter jurisdiction.

Nothing in these Terms and Conditions deprives consumers of any mandatory protection to which they are legally entitled.

Article 18 – Evidence and retention of the contract

The electronic records generated by the website, booking system, email service and payment provider may be used as evidence of communications and transactions, subject to each party’s right to provide evidence to the contrary.

The Customer is advised to retain their confirmation email and a copy of the Terms and Conditions accepted when making the booking.
